The EB-5 Deadline: Why the Right Answer Isn’t “Act Now” or “Wait”

September 30, 2026, is coming up fast, and for EB-5 investors, that date carries real weight. Depending on what happens in Washington between now and then, the cost of investment, the pace of conditional residency filings, and the shape of the program itself could all look different in the future than they do today.

Understandably, this has a lot of prospective investors asking the same question: should I move now, or should I wait and see what happens? It’s a fair question either way. We’re in a period of genuine uncertainty, and there’s no shame in wanting more clarity before committing capital and years of planning to an immigration strategy.

But that’s exactly why this decision deserves more than a gut call in either direction. This is one of the more consequential steps a family can take, and it should be made deliberately, not rushed toward a deadline and not delayed out of hesitation. Both a hasty yes and an indefinite maybe carry their own risks.

When we sit down with clients weighing this decision, we usually come back to three things worth thinking through carefully: the regional center behind the project, the attorney guiding the immigration process, and, most importantly, personal readiness. Is this the right time, financially and personally, for this family to take this step? The first two can be researched and vetted. The third only the investor can answer honestly.

Here is what we do know. The law today is the law today. What happens after September 30 is not something anyone can predict with confidence, no matter how the question is framed. Investment amounts could rise. Timelines for conditional residency could shift. It’s even possible the program is restructured or discontinued in its current form. Anyone who tells you with certainty what comes next isn’t giving you information, they’re giving you a guess dressed up as one.

What we can say is that immigration policy is moving quickly across the board right now, not just in EB-5. H-1B rules, adjustment of status procedures, and other visa categories are all seeing meaningful change, and the general direction has been toward more friction, not less. That broader climate is worth factoring in, even if no one can say exactly how it applies to any one case.

So before making a decision, we’d encourage every prospective investor to sit with three questions. Is my financial position genuinely ready for an investment of this size and this level of risk? Have I done enough diligence on the regional center and the attorney I’d be trusting with this process? And am I making this decision because it’s right for my family, or because a deadline is making me feel like I have to?

Once you’ve worked through those questions, there’s one more piece of practical advice worth adding: whichever way you decide, decide with conviction and stick to it. Set yourself a real deadline for making the call, and honor it. Arranging financing and assembling a thorough, well-documented I-526 petition takes genuine lead time, often many weeks and sometimes several months, depending on how the investment is structured and funded. That work has to happen well before September 30, not in the days right before it. We are now inside that window, which is exactly why indecision has become its own kind of risk.

There is no universal right answer here, and anyone offering one is overselling their certainty. What we can offer is this: take the deadline seriously, but let it inform your timeline rather than dictate your judgment. The investors who tend to do best with EB-5 are the ones who move with clear eyes and firm resolve, not the ones who simply move fastest.
